Eric: You have a copy of this newest map showing much more radioactive contamination on TI than originally admitted in the 2006 Historical Radiological Assessment? It's really quite extraordinary to see how many more sites have been identified, not to mention the possible spreading of RAD around the island during excavation activities, trucking, storage, etc. at sites that were not previously characterized for RAD, but now are. Hi all, New revelations of a cover-up of far more widespread radioactive contamination from Navy dumping on Treasure Island (where there is another huge Lennar condo project planned) have also given us a -major- new opportunity to roadblock Lennar's Bayview Hunters Point Shipyard project because of its even worse Navy radioactive and chemical contamination. And if no one shows up from, and to defend, the Bayview, the discussion will only focus on Treasure Island. So Lennar Shipyard opponents need to be there and speak out. Some key things we can demand are: - Both the Treasure Island and Shipyard Lennar projects must be halted immediately until a full -independent- investigation of the Navy, SF/CA Health Departments, Toxic Substances Control Department, and EPA's handling of these development sites is completed; so we can get to the truth. - Both the Shipyard and Treasure Island must be fully characterized for all toxic and radioactive contamination and NO developments can proceed until both redevelopment areas are completely cleaned to -residential- health and safety standards. - The newly created Redevelopment Successor Agency Commission must have at least three of its five members appointed (one each) from the three neighborhoods surrounding the active Redevelopment areas of: the Bayview Hunters Point, Mission Bay, and Transbay Terminal (South of Market); and the public must be given -strong- input on these appointees. - The meetings of the Redevelopment Successor Agency Commission and the Treasure Island Development Board -must- be televised live, and be well noticed, to ensure full public participation. - The hearings promised to us in 2010 on the Bayview Hunters Point Shipyard redevelopment project and the Navy dump sites must be scheduled immediately for November. No more delays! - The City's legally adopted Precautionary Principle ordinance must be followed as the governing law for these development projects. Report on CAN Nuclear Summit Meeting 9/21/12 in DC Don Eichelberger At the congressional briefing scheduled on 9/19 by Rep. Kucinich, S. David Freeman said that he had been in meetings with "some of the best people in the world", but had still seen frustratingly little movement in efforts to stop nukes. He said even the highly touted vote to shut down Rancho Seco was actually just a vote for SMUD to stop operating the nuke, and Duke, Entergy and others were lining up to run it. If not for his strategic position as head of SMUD, they would likely have had their way. So, it was with some trepidation that I stepped into the room full of some of the best people in the world I had been in a room with at the 9/21 summit meeting. About 40 people sat in the room, representing most regions of the US, many with over 30 years working on the issue. As the meeting progressed, stresses were apparent. Frustrations were expressed at the intransigents of regulators and decision-makers and the low turn-out for anti-nuclear events, including this one, with thousands protesting in Japan, Italy, and Germany. We had to remind ourselves that America is a vast, diverse, relatively conservative country, and the three countries mentioned are all about the size of California. We spent a lot of time brainstorming strategies and tactics, and there was general agreement that a vast educational campaign is needed to let people know about the dangers the mainstream media is not telling about. It was also agreed that more focus is needed on social justice aspects. Dine from New Mexico spoke of how much of the uranium came from indigenous land, and most of the wastes are likely to go there unless they can get help, which means more than white people coming in and telling them what needs to be done. They know what to do; they just need access to the resources we can provide, and to not be an afterthought of the movement. There were a great number of tactics brainstormed, but not much headway was made in prioritizing them in to a coherent strategy of actions.I have listed a few of the ideas for action below, in no particular order of priority, in the hope that folks might be enticed to follow up on them until something more coherent can be developed. Harvey Wasserman said he is interested in doing economic studies of what it would take for each of our nukes to be replaced by renewables and conservation. I have offered to help with that effort. Karl (with a K) Grossman said we need to make best use of social media to get our word out, and major environmental groups, except Greenpeace, PSR, FoE, and (maybe) Sierra Club, are not good on the issue and need work. Social justice, as mentioned above, was deemed a very important concern.As part of the mining, milling and waste issues, we also need to craft a message that speaks to the power dynamics of energy industries, and their oppressive tactics used in their siting, including decolonization of tribal lands. As well, amending the national Mine Workers' Compensation Act was an effort being made in New Mexico.Miners impacted by uranium mining after 1971 are given no benefits, and that needs to be addressed. Also, national gatherings such as this one should offer travel stipends to allow less affluent constituencies to take part.And our taking out our frustrations at each other through flaming was seen as not good for strengthening our community.Meetings of native people always begin and end with a prayer, and it was suggested that it would be good for our meetings to incorporate prayers or centering meditations and a kinder tone. There was much self-criticism at not having more people of color in attendance, and we need to focus on building minority constituencies in to our ranks.As we do so, we also need to recognize that a great many minorities come from lower economic means, and have other obstacles to participation, especially in direct action-type activities. A large number of minorities have had close shaves with police and societal racism, and do not trust the criminal justice system to look out for their free speech rights. Additionally, we must try to bridge concerns about nuclear with the realities faced in poor communities, who might be inclined to favor "clean" nuclear power as a replacement for the soot of coal and natural gas fired plants, which add to the scourge of asthma and other respiratory illnesses in these communities. Much thought needs to be given on how to sensitively bridge those gaps to involvement. Along this line, we are saddened that our first elected black president gets so much backing from the nuclear industry and is outspokenly pro-nuke.One answer to this was posed to me by a member of the National Black Political Caucus I met, who were in DC this week for a national gathering.He suggested that Michelle Obama, with her focus on childhood health and nutrition might be reachable on food safety issues, and should be approached. A lot of ideas were presented to try and break the media blockade against the issue.Mainstream media is seen largely as useless and in industry pockets, and there was a general feeling expressed that we need to tell our own stories through independent media and find innovative ways to use social media. But there was also a fear that, unless mainstream media could be mobilized, we hold slim chances of reaching a mass audience.Such ideas were suggested as setting up editorial board meetings to discuss the issue, calling media outlets and journalists who do bad, misleading or inaccurate reporting on the issue, and reaching out to media celebrities, like Tom Brokaw, and try to get their support (some feel, for instance, that Walter Cronkite's news reports had a lot of influence in stopping the Viet Nam War). Along this line, we also need to produce good visuals and research and buy magazine ads, etc. to get our word out. In the absence of mainstream media, we need to concentrate on the grassroots, and hold street actions that can involve more people, again utilizing Internet and social networks to build numbers.CAN will be discussing nationally coordinated actions the end of October in the lead-up to the election to try and get attention to the cause. Another suggestion was to form speaker bureaus to go speak at Rotary Clubs, Business Associations, Kiwanis, Elks, 4-H Clubs, student clubs, etc. Also to target constituencies who would be adversely affected by nuclear releases, such as farmers, fishermen, real estate agents, and the tourism industry. The idea was also suggested of needing to mobilize internationally on the issue, perhaps through a UN Resolution, as well as building solidarity with people of Fukushima Diichi, Chernobyl, and indigenous communities around the world impacted with contamination. We also need to focus on conservation and renewables, and make clear we do not support fracked natural gas,mountain top removal coal (or any other, for that matter) or shale oil pipelines to replace nuclear. These suggestions are what I gleaned from this gathering.A lot of information was shared, and I am sure this is not an exhaustive list of things people might do.But it is a start toward ordering thoughts that might evolve in to a PLAN. Jones The San Francisco Board of Supervisors today cast an historic vote that was more than a decade in the making, approving the CleanPowerSF program – which challenges PG&E’s monopoly by offering 100 percent renewable energy directly to city residents – on an 8-3 vote that would be enough to override an implied veto threat by Mayor Ed Lee. The outcome was far from certain throughout the two-hour hearing as conservative Sups. Mark Farrell and Carmen Chu led efforts to undermine the program, which was the final work product of retiring San Francisco Public Utilities Commission Executive Director Ed Harrington, who previously served as the city’s controller for 17 years. The pair of supervisors offered a series of amendments challenging the state requirement that city residents must proactively opt-out of such community choice aggregation (CCA) programs if they want to remain with PG&E, offering convoluted language that would have required people to opt-in to the program before its launch, and requiring that the $13 million in reserve funds from the SFPUC be covered entirely by CleanPowerSF customers, which could increase its rates. “It looks like the amendments would be harmful to the success of the program,” Sup. Eric Mar observed, prompting Farrell and Chu to flash broad conspiratorial smiles at one another. Sup. Scott Wiener, who was undecided and considered a key swing vote in reaching a veto-proof majority, said he also had concerns about the opt-out requirement and wanted to better understand how the amendments would work and whether they were legal. “For me, I’m not interested in putting any poison pills in here,” he said. Wiener posed questions about the amendments to Farrell and to Harrington, who said it was possible for the SFPUC to have CleanPowerSF customers repay the initial allocation of reserve funds over time but that he wasn’t sure how the opt-in change would work without sabotaging the program. “It harms the ability to have an intelligent conversation with people,” Harrington said, noting that rates are based on the number of customers in the program, so it would be nearly impossible to survey everyone’s potential interest without being able to tell them how their bills would be affected. As it is, the SFPUC has already done extensive surveys of which neighborhoods and demographics are likely to be interested in taking part in CleanPowerSF, initially paying about $10 more per month for 100 percent renewable energy (PG&E’s portfolio includes less than 30 percent renewable). “We’ve done extensive surveys already,” Harrington said. Based on that research, the city is initially rolling out the program to less than a third of city residents, who will be repeatedly notified about how to opt-out, anticipating about 90,000 customers remain in the initial program. The program has been repeatedly tweaked over the last eight years that it’s been in development, during which time Marin County launched a successful version of the CCA concept that was developed in San Francisco by legislators Tom Ammiano, Carole Migden, and Mark Leno. “I feel pretty comfortable trusting Ed Harrington on whether the numbers add up,” said the measure’s chief sponsor, Sup. David Campos, arguing against the Farrell/Chu amendments, later adding, “With Ed Harrington leading this charge, this is as good as it gets. If you don’t like CCA under Ed Harrington, you’re not going to like CCA.” Farrell claimed to support CCA in concept, but he strenuously objected to the opt-out requirements that Migden included in the enabling state legislation, which she had argued was the only way to make CCAs viable against PG&E’s proven willingness to spend tens of millions of dollars to sabotage would-be competitors. “It’s the wrong way to legislate, the opt-out. It’s smells of coercion,” Farrell said. Campos countered that, “The best thing we can give the consumers in San Francisco is a choice, a meaningful choice.” Wiener ultimately made a motion to delay the item by a week, something Mayor Lee yesterday told the Chronicle he wanted, in order to further study the opt-out issue, telling Farrell that his amendment “feels a little seat of the pants to me.” Campos and other progressive supervisors who were supporting CleanPowerSF argued against the continuance, noting that it has been years in development and sitting in board committees since January, while the Farrell/Chu amendments weren’t offered until this meeting had already begun. “This is not going to change because we wait a week to make a decision,” Campos said. “The terms of this deal are not going to change.” The motion for a continuance failed on a 4-7 vote, with Wiener joined by Farrell, Chu, and Sup. Sean Elsbernd (who offered no comments throughout the hearing). Then, as the vote on the Farrell/Chu opt-in amendment came up for vote, Wiener said, “I don’t feel comfortable voting for amendments that I don’t know what they’ll do,” and it failed on a 3-8 vote. Sup. Malia Cohen had earlier indicated a willingness to support the other Farrell/Chu amendment: saddling CleanPowerSF customers with paying the SFPUC back for reserve fund costs – which Harrington indicated could be dragged out over many years to minimize the impact on rates, and which might not be necessary at all if the initial program exceeds expectations. That amendment was then approved on an 8-3 vote, with Sups. Jane Kim, Christina Olague, and John Avalos opposed. Another set of amendments that would keep low-income city residents out of the initial rollout and take other steps to reduce their rates if they opted in – which was developed by Kim, Olague, and Sup. Eric Mar – was unanimously approved by the board. Then it was time for the big vote on creating the CleanPowerSF program, approving the contract with Shell Energy Northern California to administer it, and authorizing the initial $19.5 million expenditure. Would there be eight votes to override a veto by Mayor Lee, who has been under pressure by PG&E and their downtown allies to kill the program? “To be perfectly candid, I struggled mightily with this contract,” Wiener said, reiterating his concern about its opt-in requirement, noting that the measure wasn’t perfect, even though it was significantly improved from earlier versions. It sounded as if he were about to vote against it. “What we have the opportunity to do is move forward with clean power,” Wiener said, noting that even Marin County supervisors who initially opposed its CCA have come around to supporting it. “This is something I believe we should try.” And with that, the board voted 8-3 to launch the program in mid-2013, with Chu, Farrell, and Elsbernd opposed. Campos said he was “pleasantly surprised” by the vote, while key supporters say they are cautiously hopeful it will stand up during next week's final supervisorial approval on second reading and in a veto override vote, if that becomes necessary. Campos said he was thankful for the work of Harrington, who got a standing ovation after the vote as the board recognized him for his long service to the city. Earlier in the meeting, Harrington told supervisors that while the program isn’t perfect, and it contains some risks that he considers reasonable, there is no other way the city has identified to meet ambitious greenhouse gas reduction goals it has set for itself over the last decade. It is city policy to reduce emissions by 25 percent below 1990 levels by 2017 and 80 percent below those levels by 2050. “This program before you has the only chance of reaching those goals. There’s nothing else,” Harrington said. He also said “it’s an incredibly efficient way to spend money,” noting that the city has spend $90 million on solar and other renewable energy projects that power fewer than 7,000 homes, whereas this $19.5 million will power 90,000 households, possibly without ever tapping into that $13 million reserve fund set aside to cover any losses by Shell, which will buy renewable energy, a role the city hopes to eliminate as it develops its own projects. Harrington said the ultimate goal of CleanPowerSF is to develop a large enough customer base that the city could use revenue bonds to finance a wide variety of renewable energy projects – many using solar arrays along city-owned property connected to its water system stretching all the way to Hetch Hetchy Valley – that would pay for themselves. “The real issue is can you build a facility that will have this rate structure support it?” Harrington said. That’s the real power and potential of CleanPowerSF – finally taking action to address global warming, which will have a huge impact on San Francisco and future generations – as supporters noted in a rally outside City Hall before the meeting. Sen. Mark Leno said that he doesn’t usually weigh in on proposals before the board, but that, “This is an exceptional time and this is an exceptional vote. This is the time that we need to address our inconvenient truth.”

Don -------- Original Message -------- Subject: Utilities beat back community solar bill in California Date: Thu, 06 Sep 2012 12:33:29 -0700 From: Roger Herried <rogerh(a)energy-net.org> Utilities beat back community solar bill in California <http://grist.org/climate-energy/utilities-beat-back-community-solar-bill-in…> By David Roberts <http://grist.org/author/david-roberts/> One of the big pieces of a future that makes sense <http://grist.org/article/toward-a-future-that-makes-sense/> is an energy system that involves clean power, less waste, more intelligence, and a wider distribution of economic benefits. (Think locally owned solar panels hooked into a smart grid.) I lump all that under the term "distributed energy" and have been making fitful efforts to track some of the battles going on around it. The latest episode is a sad one. Last year in California, state Sen. Lois Wolk (D) set out to tackle a pretty simple problem: Access to distributed energy (mostly rooftop solar panels) is restricted to those who can afford it and own a suitable roof. About 75 percent of Californians don't fall into that category --- they either rent, don't have the equity, or have a shaded or wrong-facing roof. That's a huge market to be tapped. So she put forward Senate Bill 843 <http://grist.org/news/how-to-put-solar-panels-on-your-roof-even-if-you-dont…>, which would allow customers in the service territories of the state's three big investor-owned utilities --- Pacific Gas & Electric (PG&E), Southern California Edison (SCE), and San Diego Gas & Electric (SDG&E) --- to "subscribe" to distributed energy projects (20 megawatts or less) anywhere in their territories. So, for instance, a condo co-op could get together and invest in a solar project covering a nearby parking garage. Or a congregation could get together and invest in panels for the top of their church. They would sign a contract with a solar developer and pay a monthly fee (wrapped into their power bill) for a portion of the energy produced. Under the legislation, up to 2 gigawatts of power could be financed this way across the state; no state money would be required. According to a report by Vote Solar <http://votesolar.org/wp-content/uploads/2012/06/SB-843-job-econ-impacts-rep…> [PDF], in the process of adding 2 GW of distributed renewable energy, the program would create 12,000 new jobs, $230 million in state sales tax revenue, and $7.5 billion of economic activity in the state. The bill was backed by a broad coalition that included businesses, schools, nonprofit groups, and the Department of Defense. Sounds good, right? But it didn't sound good to the big quasi-monopoly utilities, PG&E and SCE (SDG&E supported the bill). Late last week, they led a last-minute flurry of lobbying and killed it <http://solarindustrymag.com/e107_plugins/content/content.php?content.11080>. The murder took place in the Assembly Committee on Utilities and Commerce, under what sounds like some pretty shady circumstances. Apparently Wolk made a deal with committee chair to back a scaled-down version of the program, but once committee doors shut, the chair flip-flopped. Wolk was blunt: "PG&E and Southern California Edison control the committee ... the coalition of support behind this measure was simply no match for the high paid lobbyists and the campaign contributions of these monopoly corporations." One of the utilities' objections (which are detailed in this op-ed <http://www.sacbee.com/2012/08/30/4770011/another-view-solar-bill-would.html> from PG&E) was that the bill would shift the cost of maintaining the electricity system to other customers. This is, um, bullsh*t. SB 843 was explicitly designed so that participating customers would still pay all their own transmission, distribution, and public-purpose charges. And regardless, one of the great benefits of distributed energy is that it /reduces/ those costs; you don't need new power lines when the power plant is on your roof. The utilities' alleged concern over costs is touching, but somewhat ironic. PG&E is still paying out a $70 million settlement over its boneheaded San Bruno pipeline explosion <http://www.huffingtonpost.com/2012/04/23/pge-san-bruno-explosion-memo_n_144…>. Guess where that money comes from? That's right, ratepayers. Oh, and PG&E also recently tried to bump up its guaranteed "return on equity" from 8.75 percent to 11 percent, which the Division of Ratepayer Advocates deemed "out of line with today's market and unfair to customers <http://www.dra.ca.gov/general.aspx?id=1860>." Guess where that extra annual $337 million in profits would have come from? Right again. As for SCE, its shareholders are currently banking $54 million a month in profits <http://articles.latimes.com/2012/aug/29/business/la-fi-hiltzik-20120829> for running the San Onofre nuclear plant, which, um, isn't running. Guess where that money is coming from? Yup. So really, utility concern over ratepayer costs? Spare me. I suspect the real objections were elsewhere. First, the 2 GW in distributed solar wouldn't have counted toward the utilities' obligations under California's aggressive renewable energy mandate, under which utilities have to get 33 percent of their energy from renewables by 2020. Second and relatedly, the program would effectively have cut utilities out as middlemen. Customers would have been contracting directly with power providers. That is a threat to the entire utility model, which relies on tidy planning, captive ratepayers, and a publicly guaranteed rate of return. That model all but prohibits the kind of disruptive evolution the electricity system desperately needs, but it works quite well for utility shareholders and they will fight to the death to preserve it. I don't know how the program would have played out had the bill passed. Maybe it really would have been a mishegas like the utilities warned. But these facts remain: * We need rapid evolution in the electricity sector. * Under the current regulatory regime, utilities are all but incapable of that kind of innovation. * The prospects of reforming that regulatory regime are dim. Given all that, I don't see any alternative but to go /around/ utilities, to find ways for customers --- communities, businesses, civic groups --- to work directly with microgrid and distributed energy providers. We need some of that magic that comes from a competitive market and we'll never get it as long as utilities maintain their monopoly on power. On that note: supporters of SB843 intend to redraft it and have another go at it in January.
